10. Warranties
By using this site you warrant to us that:
10.1. Any submission you make to the site does not infringe the intellectual property rights of any third party;
10.2. You are entitled to, and are not prevented from, making any submission to the site;
10.3. Any submission you make to the site and or us complies with the law and these terms.
11. Privacy
11.1. We may deal with your personal information in accordance with our privacy policy at www.makenmovies.com/privacy as amended from time to time.
11.2. We may use your personal information for promotional and marketing purposes until you request to opt out of receiving such information.
11.3. You also consent to us sending you email to advise you of changes to the site or to market the site or our services to you.
12. Termination
12.1. We may terminate your licence to use the site at anytime:
12.1.1. where you breach these terms; or
12.1.2. for any other reason we deem appropriate.
12.2. In addition to any other right of termination we may terminate your licence to use our site at anytime where we wish to discontinue our site or redevelop our site.
13. Submissions and Advertising
13.1. We may offer different advertising plans from time to time.
13.2. Where you apply to advertise with us and we agree, you will have access to your advertisements through the site.
13.3. We reserve the right to change any advertisement where we, in our absolute discretion deem appropriate.
13.4. We may at our absolute discretion terminate or suspend your access to the site or any advertisement.
13.5. If you fail to pay us money by its due date, we may suspend or terminate your advertisement without liability for any loss or damage that may arise.
13.6. We may from time to time impose conditions or rules around advertising on the site - where we do, it is a term of your agreement with us that you comply with those conditions or rules.
13.7. We may delete, remove or block access to any submission you make to the site where:
13.7.1. we believe it breaches any part of these terms;
13.7.2. it is likely to be detrimental to the site or our business;
13.7.3. any other reason that we deem appropriate.
14. General
14.1. If any provision in this agreement is unlawful or inconsistent with any law, then to the extent of the unlawful nature or inconsistency, that provision may be severed from without affecting the remainder of the agreement.
14.2. This agreement and any customer contract is governed exclusively by the law of Victoria, Australia. Any legal proceedings relating to them can only be taken in courts with jurisdiction in the State of Victoria, Australia.
14.3. No right under these terms can be waived except by notice in writing signed by the party waiving it. If a party overlooks a breach by the other party on one or more occasions, it is not taken to have agreed to any future breach.
14.4. Headings and footnotes are only for convenience. They are to be ignored when interpreting the agreement.
14.5. A reference to the singular includes the plural and vice versa.
14.6. Where one thing is said to include one or more other things, it is not limited to those other things.
14.7. There is no significance in the use of gender-specific language.
14.8. A "person" includes any entity which can sue and be sued.
14.9. A "person" includes any legal successor to or representative of that person.
14.10. A reference to a law includes any amendment or replacement of that law.
